No Charges Filed in Pedestrian Death in O.C.

Cape May County Prosecutor Jeffrey H. Sutherland announced Monday that no criminal charges will be filed as a result of a fatal motor vehicle accident in Ocean City on Memorial Day weekend. 

On May 24, at 5:34 p.m., police responded to a motor vehicle accident involving pedestrians at Eighth Street and Bay Avenue.

A 2015 Jeep Cherokee driven by Barbara L. Myers, 49, of Woodbine, struck two pedestrians in the crosswalk, Sutherland said. One of the pedestrians, Thomas F. Gibbons Jr., of Lansdale, Pa., later died in the hospital as a result of his injuries. Gibbons’ wife, Stephanie, was also hit, but survived her injuries.

An investigation into the accident was conducted by members of the Ocean City Police Department and Cape May County Prosecutor’s Office with the assistance of the New Jersey State Police.

As a result of the investigation, no criminal charges will be filed against Myers, Sutherland said. Myers was issued two motor vehicle summonses for failure to yield to a pedestrian and for careless driving. Both summonses will be handled in Municipal Court.

Cape May County recently closed the southerly crosswalk on Bay Avenue where Gibbons and his wife were hit. Pedestrians are now being directed to use the northerly crosswalk that is out of the path of motorists turning left onto Bay Avenue from Eighth Street.
